1. About Shotifi
Shotifi is an event photography platform that enables photographers, venues and event organisers to publish photos from events, and allows the public to browse, view, react to, download and purchase prints of those photos.
2. Acceptance of terms
By accessing or using Shotifi, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the site.
3. User accounts
- You must provide accurate information when registering
- You are responsible for maintaining the security of your account
- You must not share your account credentials
- We reserve the right to suspend or terminate accounts that violate these terms
4. Uploading photos
By uploading photos to Shotifi, you confirm that:
- You have the right to publish the photos (you are the photographer or have permission from the photographer)
- You have complied with all applicable laws, including GDPR and data protection regulations
- Appropriate signage was displayed at the event informing attendees that photography was taking place and that photos would be published on Shotifi
- You will promptly action any photo removal requests forwarded to you
- The photos do not contain illegal content, are not defamatory, and do not violate any third party's rights
You retain copyright of photos you upload. By uploading, you grant Shotifi a non-exclusive, worldwide licence to display, distribute and make available the photos on the platform, including generating thumbnails and watermarked versions.
5. Responsibilities of photographers & venues
Photographers, venue owners and event organisers who upload content are data controllers for the photos they publish. As a data controller, you are responsible for:
- Ensuring appropriate signage is displayed at events before photography begins
- Respecting anyone who opts out of being photographed
- Responding to photo removal requests in a timely manner
- Complying with GDPR and all applicable data protection laws
- Maintaining appropriate public liability insurance where applicable
Shotifi acts as a data processor on your behalf for the purpose of hosting and displaying the photos you upload.
6. Photo removal
Anyone who appears in a photo on Shotifi may request its removal. Removal requests can be submitted via our photo removal form. We aim to process requests within 48 hours. In all cases, valid requests will be actioned within 30 days as required by GDPR.
7. Guest uploads
Guest uploads are photos submitted by event attendees via a shared upload link. By uploading as a guest, you confirm that you have the right to share the photos and that they do not contain illegal or harmful content. Guest uploads are subject to moderation by the event organiser.
8. Purchases & downloads
- Photos may be offered as free downloads or as paid products (prints, keyrings, etc.) at the discretion of the event organiser or venue
- Paid purchases are processed through our payment provider
- Downloaded photos are for personal use only and may not be used commercially without written permission from the copyright holder
9. Prohibited use
You must not:
- Upload content that is illegal, offensive, defamatory or infringes any rights
- Use automated tools to scrape or download photos in bulk
- Attempt to circumvent watermarks or access controls
- Use the platform for any unlawful purpose
- Impersonate another person or entity
10. Limitation of liability
Shotifi provides the platform "as is". We are not liable for content uploaded by users. We do not pre-screen photos but will remove content that violates these terms when notified. Our total liability is limited to the amount you have paid to us (if any) in the 12 months preceding the claim.
11. Intellectual property
The Shotifi name, logo and platform design are the property of Focus & Co. User-uploaded content remains the property of the respective copyright holders.
12. Changes to these terms
We may update these terms from time to time. Continued use of the site constitutes acceptance of the updated terms. We will notify registered users of material changes by email.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
